CON

This part outlines specific regulation that applies to the City’s Land Use Districts.

 

5.21 CON - Conservation District

  1. Application

    This section applies to the areas designated as Conservation (CON) District on the Land Use District Map, Schedule A of this Bylaw.
  2. Purpose

    The purpose of the CON District is to provide for the protection and stewardship of Natural Area means land or water, identified as environmentally sensitive, that requires protection and stewardship. Examples include wetlands, watercourses, ravines, forests, meadows, grasslands, and riparian areas. and environmentally sensitive lands, and to preserve ecological integrity and biodiversity while allowing limited passive recreation. The intent is also to protect lands within the flood-risk area from development.
  3. Permitted and Discretionary Uses

(i) a) Natural Area means land or water, identified as environmentally sensitive, that requires protection and stewardship. Examples include wetlands, watercourses, ravines, forests, meadows, grasslands, and riparian areas. b) Accessory means subordinate, incidental to, and exclusively devoted to a principal use or principal building. Development to a Permitted Use or Discretionary Use
  1. Building Height
    1. For an Accessory means subordinate, incidental to, and exclusively devoted to a principal use or principal building., the minimum height shall be determined by the Development Authority.
  2. Setbacks
    1. Principal Building means a building that accommodates the principal use of a lot or site. and accessory buildings Setback means the distance from the foundation wall of a building to the property line at right angles or radially to it. Where there is no foundation wall, the distance shall be measured from the exterior wall at grade, not including cantilevered wall sections or architectural projections. shall be as determined by the Development Authority.
  3. Development on Properties Within the Flood-Risk Area
    1. Property adjacent to Big Lake, the Sturgeon River Valley, the Carrot Creek Valley, riparian areas, or within the flood-risk area shall be held to the following additional performance standards:
      1. Development should allow public access to public lands along Big Lake, the Sturgeon River, or Carrot Creek banks, where appropriate;
      2. Any development that disturbs the normal hydrological process within Big Lake, the Sturgeon River Valley, or Carrot Creek Valley must minimize the risk of On-Site means a location on the site which is the subject of a development. and Off-Site means a location other than the site which is the subject of a development. flood damage; and
      3. Development that includes any channelization or diking along the riverbanks shall be designed in consultation with the responsible provincial authority.
