Non-Conforming Development

2.24 Non-Conforming Development
- The Development Authority has the same meaning as set out in the MGA. may approve as a Discretionary development in any District, an enlargement, alteration, or addition to a non-conforming building, if such approval does not contravene section 643 of the MGA, and if the non-conforming Building includes anything constructed or placed on, in, over, or under land, but does not include a highway or bridge that forms part of a highway. complies with the uses prescribed for that District in this Bylaw, and if the proposed enlargement, alteration, or addition would not, in the opinion of the Development Authority:
- Unduly interfere with the amenities of the neighbourhood; or
- Materially interfere with or affect the use, enjoyment, or value of neighbouring properties.
